Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of the podcast subdomain at podcast.hodlfm.io and any audio/video interviews, podcast episodes, transcriptions, and related resources made available there (collectively, the “Services”). By using the Services you agree to be bound by these Terms and by our Privacy and Cookie Policies. If you do not accept these Terms, do not access or use the Services.
Scope of the Services
HODL FM Podcast hosts recorded video interviews and podcast episodes, including associated show notes, transcripts, and downloadable media where provided. Content is intended for informational and educational purposes about digital assets, blockchain and related topics and does not constitute financial, investment, tax, or legal advice.
Access, accounts and subscriptions
- Access to some features of the Services (for example downloads, transcripts, or subscriber‑only episodes) may require registration or a subscription. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.
- If you provide payment information for a subscription, you agree to pay applicable fees and taxes and to the billing terms presented at purchase.
License to listen and personal use
Subject to these Terms, HODL FM Podcast grants you a limited, non‑exclusive, non‑transferable license to stream and, if expressly permitted, download episodes for your personal, non‑commercial use. Except as expressly allowed, you may not copy, reproduce, distribute, publicly perform, create derivative works from, or otherwise exploit content from the Services without prior written permission.
Contributor and guest content
- Episodes may feature third‑party hosts, guests and contributors. Content contributions remain the responsibility of the original author/creator.
- If you appear as a guest on a HODL FM Podcast production, you acknowledge and agree that by participating, you grant HODL FM a worldwide, perpetual, transferable, royalty‑free license to record, reproduce, distribute, publish and otherwise use the recording, excerpts, and derivative materials in connection with HODL FM’s productions and distribution channels.
Acceptable use / prohibited conductYou must not use the Services to:
- Violate any applicable law, regulation or third‑party right;
- Upload or transmit malware, viruses, or any code intended to disrupt the Services;
- Attempt unauthorized access to HODL FM Podcast systems or other users’ accounts;
- Post or share illegal, infringing, defamatory, obscene, harassing or hateful content in comments or submissions;
- Harass, threaten, stalk or abuse other users, guests or staff; or
- Harvest personal data of other users or use the Services to send spam or unsolicited messages.We reserve the right to remove content and suspend or terminate accounts engaging in prohibited conduct.
User submissions, comments and feedback
If you post comments, questions, or other content, you grant HODL FM Podcast a worldwide, non‑exclusive, royalty‑free license to use, reproduce, modify, adapt, publish and display that content in connection with the Services. You represent and warrant that you own or are authorized to post such content and that it does not infringe third‑party rights.
Intellectual property
All content on podcast.hodlfm.io (including episodes, transcripts, show notes, logos and site design) is owned or licensed by HODL FM Podcast and protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership of HODL FM’s intellectual property to you.
Third‑party platforms and distribution
HODL FM may distribute episodes via third‑party platforms (e.g., YouTube, Spotify, Apple Podcasts). Those platforms have their own terms and privacy practices that apply when you access content there. HODL FM Podcast is not responsible for third‑party platform content or practices.
Disclaimer of warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, HODL FM Podcast disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness and non‑infringement.
Limitation of liability
To the maximum extent permitted by law, HODL FM and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill, arising out of your use of or inability to use the Services. These limitations may not apply in jurisdictions that do not permit such exclusions.
Indemnification
You agree to indemnify and hold harmless HODL FM and its affiliates, officers, directors, employees and agents from claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms or your violation of any law or third‑party right.
Privacy and data
Our collection and use of personal information is described in our Privacy Policy. By using the Services you consent to the collection, use and transfer of your information as set out in that policy.
Termination and suspension
We may suspend or terminate your access to the Services at any time for violations of these Terms or for any conduct that we reasonably believe is harmful to other users, third parties, or HODL FM. On termination, your right to use the Services ends immediately.
Changes to the Terms
We may modify these Terms from time to time. When changes are posted, the revised Terms will take effect on the “Effective date” above. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
Governing law and jurisdiction
These Terms are governed by the laws of the United Kingdom. You submit to the exclusive jurisdiction of the courts of the United Kingdom to resolve disputes arising under these Terms.
